Consular Processing Attorneys in Kansas City: What You Need to Know

For many immigrants, the dream of becoming a lawful permanent resident in the United States begins abroad. The process of applying for an immigrant visa through a U.S. consulate or embassy is known as consular processing. While this path allows many people to obtain green cards, it can also be complicated, with strict deadlines, document requirements, and in-person interviews.

What Is Consular Processing?

Consular processing applies when someone outside the United States applies for an immigrant visa. It can also apply to immigrants already in the U.S. who are required by law to leave and apply abroad before returning as permanent residents.


The process involves submitting a petition, paying government fees, providing supporting documents, and ultimately attending a visa interview at a U.S. consulate or embassy. If approved, the applicant receives an immigrant visa stamp in their passport and can enter the U.S. as a lawful permanent resident.


Key Steps in the Process

  1. Petition Approval
    A U.S. citizen or lawful permanent resident relative files Form I-130 (Petition for Alien Relative) with U.S. Citizenship and Immigration Services (USCIS). Once approved, the case is transferred to the National Visa Center (NVC).
  2. NVC Processing
    The NVC collects fees, requires completion of the DS-260 Immigrant Visa Application, and requests documents such as civil records and the I-864 Affidavit of Support. Once all requirements are met, the case is marked “documentarily qualified.”
  3. Consular Interview
    The applicant attends an interview at a U.S. consulate or embassy. A consular officer reviews the case, asks questions, and decides whether to approve or deny the visa application.
  4. Visa Issuance and Entry
    If approved, the applicant receives a visa stamp allowing them to travel to the U.S. Upon entry, they become a lawful permanent resident. After paying the immigrant visa fee online, they will later receive their green card and Social Security card in the mail.
