How an Immigration Attorney Can Help If Your Loved One Is Detained

When a loved one is taken into immigration custody, it can feel overwhelming and frightening. Families often don’t know what to expect or what steps to take first. Immigration detention is not a criminal process, but it can still have life-changing consequences. That’s why having an experienced immigration attorney by your side is essential.

At Martinez Immigration Law LLC, we help families navigate detained proceedings with compassion, urgency, and clear legal strategies.

Why Noncitizens Are Detained

Noncitizens may be detained for several reasons, including:

  • Being stopped by Immigration and Customs Enforcement (ICE)
  • Having certain criminal charges or past convictions
  • Facing a pending removal (deportation) case

Detention often takes place in county jails or detention centers, and many detainees may still have options for release through a bond hearing.

The Role of Bond in Detained Proceedings

Some detained individuals may qualify for bond, which allows them to be released from custody while their immigration case proceeds. However, eligibility depends on several factors, such as criminal history and immigration status.

An immigration attorney can:

  • Request bond directly from ICE or an immigration judge
  • Present evidence showing the individual is not a flight risk or danger
  • Argue for the lowest possible bond amount so families can reunite quickly

How Criminal Charges Impact Detention

Criminal charges can complicate detention and bond eligibility. In fact, certain convictions may disqualify a noncitizen from receiving bond. Because of this, it is critical for criminal defense attorneys to work closely with immigration attorneys.

At Martinez Immigration Law, we consult with both the detained individual and their defense attorney to ensure the immigration consequences of a guilty plea are fully understood before any decision is made.

Supporting Families Through the Process

If your loved one has been detained, you may feel powerless. An immigration attorney provides immediate support by:

  • Contacting the detention facility
  • Explaining options for bond and relief from removal
  • Representing your loved one in immigration court
  • Keeping families informed every step of the way

Having a lawyer means you don’t have to face this process alone—and your loved one’s rights are protected.

A 1940 law, the Alien Registration Act, requires all foreign nationals age 14 and older who will be in the U.S. for 30 days or more to register and be fingerprinted. Adults must always carry proof of registration, and noncompliance may result in fines, imprisonment, or removal proceedings. Although historically unenforced, the Trump administration began enforcing it on April 11, 2025, through a new online process using Form G-325R. Those required to register include many noncitizens not previously documented, such as Canadians without Form I-94, undocumented immigrants, and children turning 14. Registration does not confer legal status and may expose individuals to legal risk, so consultation with an immigration attorney is advised. Certain groups, like lawful permanent residents and visa holders already registered, are exempt. Registration is completed online, followed by a biometrics appointment, and results in a digital proof of registration.
