How to Qualify for Cancellation of Removal: A Guide for Kansas City Immigrants

Facing deportation is one of the most stressful experiences a person can endure. Fortunately, some individuals in removal proceedings may be eligible for a critical form of relief known as Cancellation of Removal. What Is Cancellation of Removal?

Cancellation of removal is a discretionary benefit granted by an immigration judge. If approved, it can either prevent your deportation or allow you to retain your green card, depending on your immigration status. There are three types of cancellation of removal:


  1. For Lawful Permanent Residents (LPRs)
  2. For Non-Permanent Residents
  3. “Special Rule” Cancellation for Battered Spouses or Children


Let’s break each one down.


1. Cancellation for Certain Permanent Residents

If you're a green card holder facing deportation—often due to a criminal conviction—you may qualify if:


  • You've been a lawful permanent resident for at least 5 years
  • You've resided in the U.S. continuously for 7 years after admission
  • You haven’t been convicted of an aggravated felony


This relief allows you to keep your LPR status and avoid removal from the U.S.


2. Cancellation for Non-Permanent Residents

Even those without legal status may qualify if they meet the following:


  • Physically present in the U.S. for 10 years
  • Have good moral character during those 10 years
  • Have not been convicted of certain serious crimes
  • Can show that their U.S. citizen or LPR spouse, child, or parent would face exceptional and extremely unusual hardship if they were deported

Approval results in being granted lawful permanent residency.


3. “Special Rule” for Survivors of Abuse

You may qualify if you or your child has been abused by a U.S. citizen or lawful permanent resident. You must show:


  • 3 years of physical presence in the U.S.
  • Good moral character
  • No serious criminal record
  • That removal would cause extreme hardship to you or your loved ones


This rule protects vulnerable immigrants and grants LPR status if approved.


Proving You Deserve Relief

Even if you meet the legal qualifications, the judge must believe you deserve this relief. That means showing:


  • Strong community ties
  • Positive contributions to society
  • Evidence of rehabilitation if you have a criminal history
  • A genuine commitment to follow U.S. laws

A 1940 law, the Alien Registration Act, requires all foreign nationals age 14 and older who will be in the U.S. for 30 days or more to register and be fingerprinted. Adults must always carry proof of registration, and noncompliance may result in fines, imprisonment, or removal proceedings. Although historically unenforced, the Trump administration began enforcing it on April 11, 2025, through a new online process using Form G-325R. Certain groups, like lawful permanent residents and visa holders already registered, are exempt.
