✔ Family Preference Categories (annual limits → longer waits):

  • F1: Unmarried adult child (21+) of a U.S. citizen

  • F3: Married child of a U.S. citizen
  • F4: Sibling of a U.S. citizen (citizen must be at least 21)


How the Petition Process Works

Depending on whether your relative is in or outside the U.S., the process will vary:


  • Adjustment of Status (inside U.S.): If the beneficiary is eligible, they can apply for a Green Card without leaving the U.S.—but only if their entry and immigration history meet legal requirements.
  • Consular Processing (outside U.S.): After the petition is approved, the beneficiary applies for an immigrant visa at a U.S. consulate and attends an interview abroad before entering the U.S. as a permanent resident.

A 1940 law, the Alien Registration Act, requires all foreign nationals age 14 and older who will be in the U.S. for 30 days or more to register and be fingerprinted.
