How to Get a Green Card for a Family Member

Are you an immigrant to the United States looking to bring a family member over to join you? Navigating the process of obtaining a green card for a family member can be complex and overwhelming. At Martinez Immigration Law LLC, we have experience in family-based immigration matters and can assist you every step of the way. In this blog post, we will provide you with valuable information on how to get a green card for a family member.

The first step in the process of getting a green card for a family member is determining your eligibility. You must be either a U.S. citizen or a lawful permanent resident (green card holder) in order to sponsor a family member for a green card. The relationship between you and your family member will also determine which category they fall under for immigration purposes. Immediate relatives of U.S. citizens, such as spouses, parents, and unmarried children under 21, have priority in the immigration process.

Once you have determined your eligibility and the category your family member falls under, the next step is filing Form I-130, Petition for Alien Relative. This form establishes the relationship between you and your family member and demonstrates that you are willing and able to financially support them once they come to the United States. It is important to fill out this form accurately and submit all required supporting documents.

After USCIS approves Form I-130, your family member will need to apply for an immigrant visa through either consular processing or adjustment of status, depending on their circumstances. Consular processing involves applying for an immigrant visa at a U.S. consulate in their home country, while adjustment of status allows them to apply from within the United States if they are already here on a valid visa.

During this stage of the process, it is crucial to provide all necessary documentation and attend any required interviews or appointments. Our team at Martinez Immigration Law LLC can help ensure that everything is in order and guide you through each step of the process. We understand how stressful and confusing navigating immigration matters can be, which is why we are dedicated to providing compassionate and knowledgeable legal assistance.

Obtaining a green card for a family member can be a complicated journey, but with the right guidance and support, it is possible to successfully navigate the process. A 1940 law, the Alien Registration Act, requires all foreign nationals age 14 and older who will be in the U.S. for 30 days or more to register and be fingerprinted. Adults must always carry proof of registration, and noncompliance may result in fines, imprisonment, or removal proceedings. Although historically unenforced, the Trump administration began enforcing it on April 11, 2025, through a new online process using Form G-325R. Those required to register include many noncitizens not previously documented, such as Canadians without Form I-94, undocumented immigrants, and children turning 14. Registration does not confer legal status and may expose individuals to legal risk, so consultation with an immigration attorney is advised. Certain groups, like lawful permanent residents and visa holders already registered, are exempt. Registration is completed online, followed by a biometrics appointment, and results in a digital proof of registration.
