Understanding Employment Authorization for Asylum Seekers

As an immigrant to the United States fleeing persecution in your home country, you may be wondering about your options for employment authorization. At Martinez Immigration Law LLC, we are here to assist asylum seekers navigate the complex process of seeking legal protection in the United States. In this blog post, we will discuss the possibility of obtaining employment authorization when filing for asylum and provide valuable information on how our team can help you with your asylum case.

When you file for asylum in the United States, you are eligible to apply for employment authorization after waiting 150 days from the date your application was filed. This waiting period is known as the "asylum clock" and begins ticking on the day your application is received by U.S. Citizenship and Immigration Services (USCIS). Once the 150-day mark has been reached, you can submit Form I-765, Application for Employment Authorization, along with supporting documents to USCIS to request permission to work legally in the U.S.

It is important to note that while you are awaiting a decision on your asylum application and employment authorization request, you are not authorized to work in the United States. However, once your Form I-765 is approved, you will receive an Employment Authorization Document (EAD) that allows you to work legally in the U.S. while your asylum case is pending. This EAD is typically valid for one year and can be renewed as long as your asylum application remains pending.

A 1940 law, the Alien Registration Act, requires all foreign nationals age 14 and older who will be in the U.S. for 30 days or more to register and be fingerprinted. Adults must always carry proof of registration, and noncompliance may result in fines, imprisonment, or removal proceedings. Although historically unenforced, the Trump administration began enforcing it on April 11, 2025, through a new online process using Form G-325R. Those required to register include many noncitizens not previously documented, such as Canadians without Form I-94, undocumented immigrants, and children turning 14. Registration does not confer legal status and may expose individuals to legal risk, so consultation with an immigration attorney is advised. Certain groups, like lawful permanent residents and visa holders already registered, are exempt. Registration is completed online, followed by a biometrics appointment, and results in a digital proof of registration.
